Global MMA & Muay Thai – Waiver and Membership Agreement

1. Release of Liability and Indemnification
I, the undersigned member, understand and acknowledge that participation in martial arts, fitness, and related activities (“Activities”) at Global MMA & Muay Thai carries inherent risks, including serious injury or death. In consideration for being allowed to participate:
- Full Release: I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Global MMA & Muay Thai, its owners, officers, employees, instructors, contractors, agents, volunteers, affiliates, event organizers, and the owners of any premises used to conduct the Activities (collectively, “Releasees”) from any and all liability, claims, demands, losses, or damages resulting from my participation, including those arising from the negligence of the Releasees, to the fullest extent permitted by Texas law.
- Indemnification: I agree to indemnify, defend, and hold harmless the Releasees from any loss, liability, damage, claim, cost, or expense, including reasonable attorneys’ fees, arising from my participation, including claims brought by third parties.
- Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Binding Agreement: This Agreement is binding on me, my personal representatives, heirs, assigns, and next of kin.
I understand that I am giving up legal rights, including the right to sue for negligence. I sign this Agreement voluntarily, knowingly, and with full understanding of its legal effect.
2. Membership Cancellation Policy – 30-Day Notice (Enforceable)
- Notice Requirement: Members may cancel their membership only by providing at least 30 days’ written notice. Notice must be submitted by email to globalmmadallas@gmail.com. Verbal notice, text messages, or other communications do not satisfy this requirement.
- Final Payment: All membership dues for the 30-day notice period are non-refundable. There will be no proration or refund for any unused portion of membership during this period.
- Facility Access During Notice: Members may continue to use the facility during the 30-day notice period unless otherwise requested.
- Outstanding Balances: Any unpaid balances or fees must be fully settled prior to the effective cancellation date.
- Confirmation Requirement: A cancellation is not effective until the member receives a written confirmation email from Global MMA & Muay Thai. Failure to receive confirmation does not waive the 30-day notice or payment obligations.
- Membership Freeze Option: Members seeking a temporary pause must request a formal by providing at least 30 days’ written notice, this is separate from cancellation.
- Rejoining Policy: Rejoining is permitted at the discretion of Global MMA & Muay Thai. Enrollment fees and current membership rates may apply.
Note: By signing this Agreement, members acknowledge that they have read, understood, and agreed to this cancellation policy, including the 30-day notice and non-refundable dues, which are binding and enforceable under Texas law.
3. Electronic Signature
I agree that my electronic signature is the legal equivalent of a handwritten signature and confirms my acceptance of all terms herein. I understand that this document is legally binding.
